We all respect the rights granted to us in the Bill of Rights. Unfortunately, many of us could stand to learn a lot more about them. 8th Amendment: Brief Overview
- “Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishment inflicted.” 8th Amendment
As you can see, the specific right to post bail doesn’t come up in the 8th Amendment; instead, it states that bail can’t have an “excessive” cost. You might notice that most of these statements don’t have a definite meaning, and use abstract ideas. This makes the Bill of Rights somewhat elastic in how it gets applied.
